The RTI Act stipulates calling of additional fee for documents and sending the same to the applicant within one month time subject to certain conditions .If the period exceeds one month time, the applicant is entitled to refund of additional fee paid vide Sec 7(3)(a) and 7(6). Thus the Industries Department of Govt.of Tamilnadu took total time of 41 days to send the documents .On appeal before the TN Information Commission, Dr.Thiru R.Perumalsamy,Information Commissioner ordered refund of additional fee of Rs.104 collected by the Industries department towards fee for additional documents vide Case No.21765/Enquiry/2009 dt. 14.12.09. In pursuance of the direction the Industries Dept refunded Rs.104 vide GO (Rt)No. 11 Industries(MID 1)Department dated 12.2.10.Like this we can approach the Appellate authority failing which the TN Information Commission for refund of already paid fee or for free supply of documents before remitting the fee for additional documents
